Sea Chart is an informational and planning aid only. It is not an official nautical chart, certified chartplotter, emergency service, or a substitute for proper seamanship. Always use current official charts, notices, appropriate equipment, a proper lookout, and safe navigational practices.
1. Who we are and acceptance
These Terms of Use (“Terms”) govern your use of the Sea Chart mobile application and related services (collectively, “Sea Chart”). Sea Chart is provided by AI Tiny Tools (“we”, “us”, or “our”). By downloading, accessing, or using Sea Chart, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Sea Chart or purchase a subscription.
You must use Sea Chart only for lawful purposes and in accordance with any rules that apply where you use it. You are responsible for your device, account credentials, vessel, crew, route planning, and compliance with applicable laws and maritime regulations.
2. Accounts and access
Some features may require an account. Keep your sign-in credentials secure and promptly tell us if you believe your account has been used without authorization. You are responsible for activity conducted through your account to the extent permitted by law.
You may request deletion of your account through the app or by following our Delete Account instructions. Please see our Privacy Policy for information about data handling and retention.
3. Navigation, weather and data disclaimer
Chart, map, depth, weather, tide, AIS, location, route, icon, imagery, and offline data may be incomplete, inaccurate, delayed, unavailable, or unsuitable for your situation. Coverage and features vary by location, device, network, account, and data provider.
You must independently verify all information and exercise your own judgment. Do not use Sea Chart as your sole source of navigation or safety information, for safety-of-life decisions, or where an error could cause injury, death, loss, or damage. Use official charts, notices to mariners, local forecasts, required equipment, and competent seamanship at all times.
4. SeaChart Pro subscriptions and purchases
SeaChart Pro may provide access to premium charting, weather, navigation, or other features. Available plans may include monthly, six-month, and annual auto-renewing subscriptions. Plan availability, eligibility, price, currency, taxes, trial terms, introductory offers, and included features are displayed in the app and at the relevant store checkout before you purchase.
- Payment is charged by the store or payment provider you selected at confirmation of purchase.
- Auto-renewing subscriptions renew automatically for the same subscription period unless you cancel before the end of the current period.
- Your renewal price, billing frequency, and next renewal date are shown by the relevant store and on its receipt or subscription-management page.
- You can manage or cancel a Google Play subscription through Google Play’s subscription controls. You can manage or cancel an Apple subscription through your Apple Account subscription settings. Cancellation stops the next renewal; access normally continues until the end of the already-paid period.
- Where permitted by the store and applicable law, subscription changes, pauses, refunds, payment failures, and billing disputes are handled under the applicable store or payment-provider rules. We do not promise refunds except where required by law or granted by the relevant store.
We may change available plans or prices for future subscription periods. If a change affects an existing auto-renewing subscription, the relevant store will provide notice and obtain any consent required by its rules or applicable law.
5. Platform-specific terms
Android / Google Play. Purchases made through Google Play are also governed by the Google Play Terms of Service and Google’s applicable payments and subscription policies. Google Play processes billing and provides the subscription-management controls for those purchases.
iOS / App Store. Purchases made through Apple’s App Store are processed by Apple and are subject to Apple’s applicable terms. For the iOS app licence, Apple’s Standard End User License Agreement applies unless a custom EULA is presented in App Store Connect. These Terms supplement, and do not replace, the applicable Apple terms.
6. Third-party data and services
Sea Chart may use data, maps, imagery, forecasts, tides, AIS feeds, and services supplied by third parties. Their availability and accuracy are not under our control, and their own terms, licences, attributions, and restrictions may apply. See our data licences and acknowledgements for applicable source information. Nothing in these Terms grants you rights to copy, redistribute, scrape, or commercially use third-party data beyond rights expressly granted by the relevant provider.
7. Intellectual property
Sea Chart, including its software, design, branding, and our original content, is owned by AI Tiny Tools or its licensors and is protected by applicable intellectual-property laws. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use Sea Chart for its intended purpose. You may not copy, modify, reverse engineer, lease, sell, distribute, or exploit any part of Sea Chart except as allowed by law or with our written permission.
8. Acceptable use
You must not misuse Sea Chart, interfere with its operation or security, bypass access controls, use it to infringe another person’s rights, upload unlawful content, or use it in a way that could damage, disable, or overburden the service. We may restrict or suspend access where reasonably necessary to protect users, the service, our partners, or to comply with law.
9. Service changes and availability
We may update, change, suspend, or discontinue features, data sources, or services at any time. We do not guarantee that Sea Chart or any particular data source will always be available, uninterrupted, error-free, current, or compatible with every device. We will use reasonable efforts to maintain the service, but connectivity, device settings, and third-party services can affect availability.
10. Disclaimers and limitation of liability
To the maximum extent permitted by law, Sea Chart is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. AI Tiny Tools does not warrant that Sea Chart will meet your requirements or that any data will be accurate, complete, timely, or fit for a particular purpose.
To the maximum extent permitted by law, AI Tiny Tools will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss arising from navigation decisions, data errors, service interruption, lost data, lost profits, or use of or inability to use Sea Chart. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
11. Changes to these Terms
We may update these Terms from time to time by posting a revised version on this page and changing the “Last updated” date. Material changes may also be communicated through the app or by other reasonable means. Your continued use of Sea Chart after the revised Terms take effect means that you accept them, to the extent permitted by law.
